Brais Law Firm can structure your fee arrangements in three ways — contingency, hourly or a hybrid of the contingency and hourly.
Most injury claims are handled on a contingency fee basis, which allows injured individuals to pursue their rights without risk. Under the contingency fee arrangement, we represent you without charging you lawyers’ fees. We do not bill you until the conclusion of your case, when we have recovered damages through a verdict or a settlement. Although rare, if we were not able to recover any damages, you would owe us nothing.
The amount of lawyers’ fees we bill is based on a percentage of your total damages award. The contingency arrangement, therefore, aligns our interests with yours.
A contingency fee payment plan may be established for cases involving personal injury, automobile accidents, medical malpractice, products liability or premises liability.
Hourly billing might be a better option for some clients. This arrangement charges clients for the time required to complete specific tasks. For example, hourly billing would be appropriate for filing an appeal or for seeking counsel on personal injury issues in an unrelated claim. You keep the full amount recovered through a verdict or settlement.
We charge hourly, billing in six minute intervals, that we track through our sophisticated computer billing system. We also monitor our expenditures on the database and can generate a report detailing exactly what you owe at any given time.
Hourly and Contingency Hybrid Arrangement
Our law firm takes some complex products liability and subrogation matters on a hybrid hourly and contingency basis. Under this fee structure, you pay a reduced hourly rate and all costs associated with the case. At the conclusion of your case, we calculate our contingency fee based on the gross recovery less the hourly fee you have already paid. Our firm only earns the additional fee if the contingency fee exceeds the hourly fees previously paid.
