What is a Premises Liability Lawsuit?
A premises liability lawsuit involves a person that goes to the property of someone else and thereafter suffer injuries as a result of a condition on the property. There are generally three categories of people. There are guests, perhaps the resort who invites people to their premises to effect repairs. There’s a third category of people, those are trespassers. There’s essentially little to no duty owed to a trespasser. If a property owner is made aware of a trespasser, a duty may be owed to the trespasser.
The burden for a law firm helping anyone in this particular situation would be, one: to identify what the condition is. Second part: can it be proven that the owner of the property, hotel resort, knew of the unsafe or defective condition that obviously fell thoroughly evaluate the individual’s damages. All of these need to be looked at by any firm handling a premises liability case.
