What is Premises Liability?
A premises liability claim is when a person is on the property of another. That person can occupy really three statuses if you will. They can be a guest, they can be a business invitee, or you could even technically be a trespasser. Every single one of those three people or statuses are owed a somewhat different duty by the property owner. With regard to the property, the property owner generally owes a reasonable duty of care to ensure that the property is reasonably safe.
If there’s a dangerous, defective, or unsafe condition on the property, they minimally have to immediately warn and then they have to remedy. When they don’t exercise that reasonable care and a person suffers a slip and fall or even much more serious personal injury, then there exists premises liability case which our firm can help them with.
